How to Buy Out an Ex’s Share of a Mortgage in Ireland

Woman with head in hands

When a relationship ends but a joint mortgage remains, things can quickly get complicated. At SYS Mortgages, we know that life doesn’t always go to plan – but your financial future doesn’t need to suffer because of it. Whether you’re in Limerick or living anywhere across Ireland, we’re here to guide you through the process of buying out your ex from a mortgage.

Cohabiting couples make up a growing share of homeowners. With house prices still climbing, it often makes sense to share the cost of buying a home. But when love fades, the joint responsibility of a mortgage can feel like a heavy chain. The good news? With the right advice and support, it’s absolutely possible to buy out your ex and move forward – financially and emotionally.

Here’s our expert guide to navigating a mortgage buyout, step by step.

1. Check for a Cohabitation Agreement

Before you do anything, check whether you and your ex signed a cohabitation agreement. Under Irish law (Civil Partnership and Certain Rights and Obligations of Cohabitants Act 2010), this document outlines what happens to shared property if the relationship ends.

If you have one, it could simplify the entire process. If not, don’t panic – we’ve helped many clients through this process without one. Our advisors can liaise with your solicitor and help you understand your options.

2. Understand Your Legal Position

Who owns the property? If both your names are on the title deeds, you are legal co-owners. If only one name appears, things can get more complex. A non-owner may still have a claim if they’ve contributed to the purchase, deposit, or mortgage repayments.

At SYS Mortgages, we’ll help you determine the structure of ownership and advise how that affects your ability to proceed. Knowing your rights early on avoids costly surprises down the road.

3. Get a Property Valuation and Calculate Equity

Next, you’ll need a professional valuation. This determines the current market value of your home and helps you calculate how much equity is available -and how much you’ll need to pay your ex.

Let’s say your home is worth €450,000 and you owe €250,000. That leaves €200,000 in equity. If you own the home equally, you’ll need to pay your ex €100,000.

SYS Mortgages can recommend trusted valuers and help you crunch the numbers to figure out what’s affordable.

4. Secure Mortgage Approval in Your Own Name

This is often the biggest challenge. You’ll need to prove you can handle the full mortgage alone under current Central Bank of Ireland mortgage lending rules. This generally means borrowing up to 3.5 times your income (unless you qualify for exemptions).

Our expert brokers will assess your finances and submit your mortgage application to the lenders most likely to approve you. We work with all major banks and have insight into their lending criteria. Better still, we can often secure approval within 24 hours.

5. Talk to Your Lender – Or Find a New One

You can either try to have the existing mortgage transferred to your name (with the bank’s approval) or apply for a switch to a different lender. In many cases, a fresh mortgage is quicker and comes with better rates – something we specialise in securing.

SYS Mortgages is your direct line to the best remortgage deals on the market, including options that may not be publicly advertised. We’ll handle all communication with lenders and keep the process as stress-free as possible.

6. Plan for Potential Roadblocks

Not all breakups are amicable. If your ex refuses to sell their share or demands an inflated sum, things can stall. In such cases, mediation or legal action may be necessary.

SYS Mortgages can’t offer legal advice, but we collaborate with solicitors across Ireland and can help you build a case that supports your buyout or sale.

7. Consider Selling the Property

If a buyout isn’t viable, selling the property might be the best option. You can clear the mortgage, split the proceeds, and both move on with a clean slate.

We can help you review the numbers, liaise with estate agents, and prepare for your next mortgage – whether you’re buying again as a single applicant or with a new partner.
